PALESTINE, Texas — A high-profile hearing that could determine the future of Texas death row inmate Robert Roberson is set for Wednesday morning.

Roberson was originally scheduled to be executed in October 2024 for the 2002 death of his 2-year-old daughter, Nikki Curtis. He was convicted in 2003, but has maintained his innocence ever since, arguing that his daughter’s death was not caused by abuse, but by a combination of serious medical issues. 

His attorneys now say he was wrongfully convicted based on what many experts now call “junk science,” which is the controversial shaken baby syndrome theory.

The hearing was requested by the Texas Attorney General’s Office, which is asking Judge Austin Reeve Jackson to formally set a new execution date. Roberson’s legal team strongly opposes the request, citing newly submitted evidence pointing to his innocence and a pending habeas corpus appeal currently before the Texas Court of Criminal Appeals.

Roberson’s attorneys say that Nikki had pneumonia and other health complications, and that a fall from a bed, not violent shaking, is what contributed to her death. They argue that the original medical conclusions used to convict him have since been discredited by multiple experts, including pathologists and former investigators.

The hearing will be held at the Anderson County Courthouse in Palestine, Texas, with live coverage on WFAA+ beginning with testimony scheduled to start at 10 a.m. CT.
